Prepared on: 18.08.2026
1. Data Controller
The controller of personal data collected through the online shop available at falbatech.click (the "Shop") is
FalbaTech Jan Jakub Falba, a sole proprietor registered in Poland, with its registered address at Cibórz 2, 13-230
Lidzbark, Warmińsko-Mazurskie Voivodeship, Poland, tax identification number (NIP): PL571-166-34-76, REGON:
281594214 (the "Controller").
You can contact the Controller on data protection matters by e-mail at contact@falbatech.click or by post at the
address above.
The Controller processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament
and of the Council of 27 April 2016 (the "GDPR") and applicable Polish implementing legislation. The Controller
applies this same standard of protection to customers worldwide, regardless of their location.
2. What Data We Collect
From Customers placing an Order we collect: name, delivery address, e-mail address, phone number, and, for
business Customers, company name and tax ID.
Payment details (e.g. card numbers) are processed directly by our payment providers (Stripe, PayPal) and are not
transmitted to or stored by the Controller.
From Customers ordering custom-made Products, we additionally collect the data needed for personalisation (e.g.
selected dimensions, engraving text, or graphic files submitted by the Customer, where applicable).
From all visitors to the Shop, we automatically collect certain data about site usage: IP address, browser and device
type, internet service provider, approximate location, and data collected through cookies (see Section 10).
People who contact the Controller by e-mail or through a contact form provide the data needed to respond,
typically name, e-mail address, and message content.
3. Purposes and Legal Basis for Processing
Customer data is processed to conclude and perform the sales contract, including fulfilling the Order, processing
payment, delivering the Product, and handling complaints and returns (legal basis: Article 6(1)(b) GDPR, necessity
for the performance of a contract).
Data needed to issue invoices and comply with accounting and tax obligations is processed under Article 6(1)(c)
GDPR (compliance with a legal obligation), in connection with Polish accounting and tax law.
Data of people contacting the Controller is processed to respond to their inquiry, under Article 6(1)(f) GDPR (the
Controller's legitimate interest in handling correspondence).
Data about Shop usage (including some cookies) is processed to ensure the Shop functions correctly and securely,
and for analytics and statistics, under Article 6(1)(f) GDPR or, for cookies requiring consent, under Article 6(1)(a)
GDPR (consent).
Where a Customer gives separate, voluntary consent to receive marketing communications (e.g. a newsletter),
their data is processed for that purpose under Article 6(1)(a) GDPR until consent is withdrawn.
4. Recipients of Data
Personal data may be shared with providers the Controller uses to perform the sales contract, in particular:
payment providers (Stripe, PayPal), postal and courier companies handling delivery, the Shop's hosting provider,
the Controller's accounting service, and analytics providers, where used on the Shop.
1FalbaTech | Privacy Policy
Data may be disclosed to public authorities where required by applicable law (for example, upon request from a
court, prosecutor, or tax authority).
Every provider the Controller engages to process personal data on its behalf does so only under a documented
data processing agreement, and only on the Controller's instructions.
5. International Data Transfers
Our payment providers (Stripe, PayPal) may transfer personal data outside the European Economic Area, including
to the United States, due to the location of their infrastructure.
Such transfers rely on safeguards recognised under the GDPR, in particular the European Commission's Standard
Contractual Clauses, as implemented by the relevant payment provider. Further detail is available in Stripe's and
PayPal's own privacy policies.
6. Data Retention
Data related to the conclusion and performance of a sales contract is kept for the duration of the contract, and
afterwards for the period required by Polish accounting and tax law (generally 5 years from the end of the calendar
year in which the relevant tax obligation arose).
Data processed on the basis of consent (e.g. for marketing) is kept until consent is withdrawn.
Data of people who contact the Controller is kept for as long as needed to respond, and for the limitation period
applicable to any claims arising from the correspondence.
7. Your Rights
You have the right to: access your data, rectify it, erase it, restrict its processing, data portability, object to
processing based on Article 6(1)(f) GDPR, and withdraw consent at any time without affecting the lawfulness of
processing carried out before the withdrawal.
EU/EEA data subjects also have the right to lodge a complaint with a supervisory authority; in Poland this is the
President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193
Warsaw). Customers outside the EU/EEA may have equivalent rights under their own local law.
To exercise any of these rights, contact the Controller at the e-mail address in Section 1.
8. Providing Your Data Is Voluntary
Providing personal data is voluntary but necessary to conclude and perform a sales contract, respond to an inquiry,
or use certain features of the Shop. Declining to provide data needed to fulfil an Order will prevent that Order from
being placed and processed.
9. Automated Decision-Making
The Controller does not make decisions about Customers based solely on automated processing, including
profiling, that would produce legal effects concerning them or similarly significantly affect them.
10. Cookies
The Shop uses cookies, small text files stored on a visitor's device, to ensure the Shop functions correctly,
remember visitor preferences, provide security (e.g. automatically logging out an inactive session), and for
analytics and statistics.
Cookies strictly necessary for the Shop to function are set automatically. Analytics and marketing cookies are set
only with the visitor's consent, given through the cookie banner shown on first visiting the Shop, in line with
applicable EU and Polish e-privacy law.
Visitors can change their cookie settings at any time in their browser, including blocking cookies or deleting those
already stored. Restricting cookies may affect some features of the Shop.

11. Data Security
The Controller applies technical and organisational measures appropriate to the risks and the categories of data
involved, to protect personal data against unauthorised disclosure, unlawful processing, and accidental alteration,
loss, damage, or destruction.
Access to personal data is limited to people authorised by the Controller, to the extent necessary for their duties.
12. Changes to This Privacy Policy
The Controller may update this privacy policy from time to time, in particular to reflect changes in applicable law,
new Shop features, or new analytics/marketing tools. The current version is always available on the Shop's
website.
